Welcome to RecruitWell AI, a platform owned and operated by Bestemploy Trade OÜ, an Estonian company registered at Harju maakond, Tallinn 11317, Kesklinna linnaosa, Pärnu mnt 148, Estonia.
These Terms and Conditions (the “Terms”) apply to companies and organizations (the “Client”, “you”, or “your”) who use the services of RecruitWell AI for recruiting, screening, and evaluating job candidates using our AI-driven solutions (the “Service”).
By signing up, accessing, or using the RecruitWell AI platform, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Use of the Service
1.1 Eligibility
To use the Service, you must be a legal entity or a representative acting on behalf of a legal entity with full authority to bind the organization to these Terms.
1.2 Account Creation
You are responsible for providing accurate company information and maintaining the confidentiality of your account credentials. You are liable for all activity under your account.
1.3 Service Description
RecruitWell AI provides AI-powered tools for candidate screening, video interviews, and assessment automation. We reserve the right to improve, modify, or discontinue features of the Service at any time.
2. Fees and Payment
2.1 Subscription & Billing
Access to some or all of the Service may require payment under a subscription plan. Details about pricing and billing are provided on our website or directly through your account dashboard.
2.2 Invoices & Taxes
You are responsible for all applicable taxes, except those based on our income. Invoices are issued in euros (EUR) and must be paid by the due date indicated.
2.3 Late Payment
Late payments may result in suspension or termination of your access to the Service.
3. Your Responsibilities
3.1 Compliance with Laws
You agree to use the Service in compliance with all applicable local, national, and international laws and regulations, including data privacy and employment laws.
3.2 Content & Usage
You are solely responsible for the job descriptions, data, and any information you input or upload to the platform. You may not use the Service to upload or distribute unlawful or discriminatory content.
4. Data Protection
4.1 Processing of Personal Data
Both parties agree to comply with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 (“GDPR”). RecruitWell AI acts as a data processor for any personal data processed on your behalf.
4.2 Data Security
We implement reasonable technical and organizational measures to protect personal data against unauthorized access, loss, or disclosure.
5. Intellectual Property
5.1 Our Rights
All rights, title, and interest in and to the RecruitWell AI platform, including its software, content, branding, and AI models, are owned by Bestemploy Trade OÜ or its licensors.
5.2 License to Use
You are granted a limited, non-exclusive, non-transferable license to use the platform for your internal recruitment purposes during the term of your subscription.
6. Confidentiality
6.1
Both parties agree to treat any confidential information received from the other as confidential and not to disclose it to third parties, except as required by law.
7. Limitation of Liability
7.1
To the fullest extent permitted by law, RecruitWell AI and Bestemploy Trade OÜ shall not be liable for any indirect, incidental, or consequential damages, loss of profits, or loss of data arising from your use of the Service.
8. Termination
8.1 By You
You may terminate your account at any time through your dashboard. Termination does not relieve you of your obligation to pay outstanding fees.
8.2 By Us
We may suspend or terminate your access to the Service if you violate these Terms or if payment is overdue.
8.3 Effects of Termination
Upon termination, your access to the platform will be disabled, and we may delete your data after 30 days unless otherwise required by law.
9. Amendments
9.1
To the fullest extent permitted by law, RecruitWell AI and Bestemploy Trade OÜ shall not be liable for any indirect, incidental, or consequential damages, loss of profits, or loss of data arising from your use of the Service.
10. Governing Law and Jurisdiction
10.1
These Terms shall be governed by and construed in accordance with the laws of Estonia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia.
